As part of the performance assessment process, NRC will take the necessary steps to ensure that the agreement`s state radiation control programs remain appropriate and compatible. These measures may contribute to the more frequent review of the IMPEP of agreement status programmes and assistance in addressing problems or areas that need to be improved within the framework of a contracting state programme. Monitoring, enhanced supervision, parole, suspension or termination of an agreement may be used in the event of failures or emergencies (. B for example, loss of funding, natural or human events, pandemic). NRC`s actions to address program deficiencies or emergencies are implemented through a clearly defined and consistently and fairly implemented process. An “appropriate” program includes the elements of a radiation control program necessary to maintain an acceptable level of public health and public safety protection within a contracting state. A State`s radiation control program under the Convention is sufficient to protect public health and public safety where program management provides appropriate safeguards for the protection of public health and public safety in regulating the use of contract equipment. The level of protection for elements of NRC`s materials regulation program is considered sufficient to ensure adequate safety for the protection of public health and public safety. Therefore, the overall level of public health and public safety protection provided by a public program should be equivalent to or, in some cases, higher than the level provided by the NRC program. In order to ensure adequate security for the protection of public health and public safety, a State Programme Agreement should contain the five essential elements of the program identified in point (i) by this section, which will be used by NRC and State Parties to define the scope of the program. NRC and States Parties will, where appropriate, review other elements of a contracting state`s program that appear to affect the program`s ability to provide appropriate safeguards for the protection of public health and public safety. The NRC will minimize the number of NRA regulatory requirements that States Parties must agree to in order to maintain compatibility. At the same time, the requirements in these compatibility categories allow NRC to ensure that there is an orderly model for the regulation of contract equipment at the federal level.
The NRC believes that this approach strikes the right balance between the need for state flexibility in the agreement and the need for a coherent and compatible NMP with the regulation of contract equipment across the country. 3. For the purposes of this statement of principle, “program element” refers to any element or function of a radiation control program, including legally binding provisions and other requirements for regulated persons contributing to the implementation of the program. In EN of October 6, 2017, in FR Doc. 2017-21542, please add the statement on the policy of the contracting state program. 4. The general licence authorizes the possession or use of radioactive material for more than 180 days in a calendar year or activities authorized in paragraph (a) of this section, unless the general licence under paragraph (a) of this section relating to activities in offshore waters gives that person the right to hold or use radioactive materials. or to carry out the activities authorized for an unlimited period of time.
